Because the theft took place while Ukraine remains under martial law, prosecutors charged him under Part 4 of Article 185 of the Criminal Code, which imposes stricter penalties for theft committed during wartime. The Kyiv district court accepted this qualification and handed down the maximum custodial sentence allowed under the provision.
The State Judicial Administration of Ukraine confirmed that the five‑year deprivation of liberty was ordered but that the man was released from actual imprisonment and placed on probation for one year.
